Terms of Service

Welcome to Curato! These Terms of Service ("Terms") govern your access to and use of the Curato application, website, and services ("Service"). By using the Service, you agree to be bound by these Terms. Please read them carefully.

1. Service Description

Curato ("the Service") provides a suite of tools for file and text sharing. Our features include:

  • Temporary Server Transfers: Upload files or text that are temporarily stored on our servers and accessed via a code or link. These are automatically deleted after a set time or after the first download.
  • End-to-End Encryption: By default, server transfers are end-to-end encrypted, meaning we cannot view your content. Unencrypted transfers are available as an option for convenience.
  • Peer-to-Peer (P2P) Transfers: Share files directly between devices using WebTorrent technology, where your data does not transit through our servers.
  • Permanent Shares: Create public, unencrypted pages to permanently host and share files.
  • Lockers: Create private, reusable storage vaults protected by your email and a 6-digit code. Files in lockers are not end-to-end encrypted by default and are stored until you delete them.

2. User Responsibilities

You are solely responsible for your conduct and the content you upload, share, or transmit through the Service. You agree to comply with all applicable local, state, national, and international laws and regulations in connection with your use of the Service.

3. Acceptable Use Policy

You agree not to use the Service to upload, store, share, or transmit any content that:

  • Is Illegal or Promotes Illegal Activity: This includes, but is not limited to, child sexual abuse material (CSAM), content that promotes terrorism, or any material that infringes on the intellectual property rights of others (e.g., copyrighted movies, music, or software you do not have the rights to distribute).
  • Is Harmful or Abusive: Content that is defamatory, obscene, pornographic, vulgar, offensive, harassing, threatening, hateful, or promotes discrimination or violence against individuals or groups based on race, ethnicity, religion, sexual orientation, disability, or any other protected status.
  • Contains Malicious Code: Content that contains viruses, malware, trojan horses, worms, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
  • Is Deceptive or Fraudulent: This includes phishing, scams, or any attempt to impersonate another person or entity.

We have a strict zero-tolerance policy for the distribution of Child Sexual Abuse Material (CSAM). Any such content discovered will be removed, and the incident will be reported to the appropriate law enforcement agencies, including the National Center for Missing & Exploited Children (NCMEC).

4. Content Ownership and Moderation

You retain ownership of any intellectual property rights that you hold in the content you share. When you upload content to the Service, you are responsible for it. Curato is a passive conduit for your content.

While we champion privacy and utilize end-to-end encryption for many of our services, this does not grant a license to share illicit content. For publicly accessible and unencrypted content (such as Permanent Shares and Lockers), we reserve the right, but do not assume the obligation, to review and remove content that violates these Terms. We may also investigate content in response to reports of abuse.

We provide a "Report Abuse" feature on public pages. We will investigate valid reports and may take any action we deem appropriate, including content removal and reporting to authorities.

5. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.

IN NO EVENT WILL CURATO, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF THE USE OF, OR INABILITY TO USE, THE SERVICE, INCLUDING FOR ANY DATA LOSS, CORRUPTION, OR UNAUTHORIZED ACCESS TO YOUR INFORMATION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

6. Indemnification

You agree to indemnify and hold harmless Curato and its developers from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

7. Changes to Terms

We reserve the right to modify these Terms at any time. We will post the most current version on this page. By continuing to use the Service after changes become effective, you agree to be bound by the revised terms.
